FBI Files Reveal Fang Fang's Potential Role as Source in Swalwell Investigation

Recent declassified FBI records reveal new details about Rep. Eric Swalwell's connection to Fang Fang, a suspected Chinese intelligence operative known as Christine Fang in the U.S. While Fang was previously recognized for her fundraising efforts and connections to Swalwell's office, the newly released documents indicate that the FBI sought to develop her as a source in 2013, assigning her the code name "Rusty Thumbs."

Fang's background is notable; both of her parents were identified as officers in China's Ministry of State Security (MSS). This connection reportedly provided her access to influential figures within the People's Republic of China (PRC). The FBI was interested in establishing a fee-for-service relationship with Fang, anticipating her ability to report on MSS influence campaigns targeting the U.S. government.

The MSS is China's primary civilian intelligence and counterintelligence agency, with operations that extend beyond traditional espionage to include cyber and industrial espionage, domestic surveillance, and influence operations aimed at foreign governments. Fang's motivations for engaging with the FBI included a desire for money and power, as she was described as socially adept but potentially egotistical, which raised concerns about her suitability as a source.

Fang was actively involved in political campaigns and community organizations, seeking recognition in both the U.S. and China. The FBI's interest in her connections extended to various Bay Area city governments, which could provide insights into Chinese business activities in the region. Records indicate that Fang sought assistance with her visa and expressed intentions to apply for a Social Security card. It remains unclear whether she was formally registered as a Confidential Human Source (CHS), although she did sign an Independent Contractor Agreement with the FBI's front company in June 2013.

Fang later became the subject of a separate investigation, code-named Freshman Fifteen, which began in March 2014. This probe focused on Swalwell's potential involvement in illegal campaign contributions linked to Fang, who was described as facilitating access to Swalwell and internships in exchange for campaign donations. Notably, while the FBI was attempting to develop Fang as a source, she was also active in Swalwell's campaign, expressing a desire to contribute despite knowing it was illegal as a foreign national.

Investigators found that Fang used American citizens as conduits to mask her identity as a foreign national making campaign contributions. The FBI's analysis indicated that Fang orchestrated multiple contributions in 2013 and 2014, with evidence tracing back to her. Federal election law prohibits foreign nationals from contributing to American elections, directly or indirectly, and the FBI believed Fang's actions fit this illegal pattern.

Witnesses reported Fang encouraging contributions at fundraisers and offering to reimburse donors, further complicating the investigation. In March 2015, the FBI sought authorization for a confidential source to make a legitimate campaign contribution to Swalwell's campaign, highlighting Fang's attempts to conceal her foreign national status.

During a May 2015 interview, Swalwell acknowledged having had physical relations with Fang but insisted they did not maintain a romantic relationship. He confirmed that Fang referred interns to his office, although he later described her as unique in this regard due to her association with the Asian Pacific Islander American Public Affairs Association.

The investigation aimed to gather evidence for potential indictments against Swalwell and Fang for campaign finance violations. However, by February 2017, the FBI concluded that Swalwell had not violated federal corruption statutes, shifting the focus solely to Fang. The investigation revealed potential violations by Fang, including illegal contributions and acting as an unregistered foreign agent.

Ultimately, Fang left the U.S. and was barred from re-entry. The FBI determined that prosecution was not viable due to national security reasons, although the specific considerations remain undisclosed in the declassified records. This case highlights ongoing concerns about foreign influence in U.S. politics and the complexities of intelligence operations.
